Vivek Tandon is the Founder and CEO of EB5 BRICS – the go-to source for everything related to EB-5 Green Card Program. A lawyer and an investment banker, Vivek’s primary focus is on educating investors in India and Dubai about EB-5 Visa Program and EB-5 regional center projects and EB-5 direct investments. As an EB-5 Advisor, Vivek focuses on the investment side of EB-5 providing where to invest and where not to invest to make sure of a safe and secure investment. On the investment side there are multiple investment options in the market from EB-5 regional centers. Regional centers are government approved businesses that act as an intermediary between EB-5 investors that want a Green Card by Investment and generally a developer that is looking for money to build something. We look at multiple investment options every single month but unlike the regional centers we are highly regulated in the U.S. by FINRA and SEC – these are financial regulatory bodies in the U.S. Thus, Vivek has a fiduciary duty to the investors to make sure their financial interests are well protected and have a duty of due diligence as to the project to make sure that the project makes sense from a financial and compliance perspective. Although he is a lawyer, he does not handle the legal and immigration side. Vivek works with select immigration law partners that handle the legal immigration aspects while he focuses on the investment aspect. Between the immigration law firm and the investment bank EB5 BRICS does regional center due diligence, project intelligence and immigration due diligence so at the end of the day very few projects make it into our portfolio. Generally there are 3-4 projects from EB-5 regional centers and developers that we are quite comfortable and confident in terms of green card approvals and return of capital. These are tried and tested players doing tried and tested things meaning either they have seen the entire EB-5 life-cycle or most of the EB-5 Visa life cycle which is investment, filing, approval, conditional green card, unconditional green card and return of capital and possible redeployment. EB-5 investments are generally not growth investments. They’re mostly a green card investment so the goal is to always focus on capital preservation and the best outcome of getting the conditional green card, unconditional green card and return of capital and that approach has worked well.

Prior to starting EB5 BRICS, Vivek worked as an in-house attorney overseeing contractual matters and acted as the business development head of a legal technology and services outsourcing company that was based in India where he learned the intricacies of how business and law come together to impact a company’s bottom line. Vivek has vast experience as a litigation lawyer and worked at a national firm in Los Angeles litigating consumer protection matters. As a public defender, he represented parents in juvenile courts in Los Angeles and Santa Clara Counties. Vivek received his law degree from Suffolk University School of Law, and in addition to working for his Immigration Law professor, he interned at the Los Angeles County District Attorney’s office assisting in criminal prosecution matters. Prior to law school, Vivek worked as an underwriter for a national mortgage bank after receiving his Bachelor in Finance and Business Administration from California State University Long Beach. In 2018-2019, Vivek successfully completed Harvard Business School’s, Senior Executive Leadership Program – India and gained a deeper understanding of business and finance. Vivek is very active in the South Asian Bar Association of Southern California and The Indus Entrepreneurs and has served on the executive board of the North American South Asian Bar Association.

Vivek’s parents brought him to the United States in 1993 when he was 14-years old. Growing up in a middle-class family in New Delhi, India, Vivek learned early on the value of honesty and hard work and put those values to work in his professional and personal pursuits in the United States. Vivek is very thankful to his parents for giving him access and opportunity to live and work in one of the best countries in the world. Vivek lives in Southern California with his Chocolate Labrador ‘Russell’ and a Tibetan Terrier “Sona” and fully enjoys the outdoor lifestyle that California offers with occasional trips to the Hawaiian Islands, Mexico and the Caribbean.
