DS-230 Application Summary

DS-230 application allows an investor and their dependents to commence their residency on the Conditional Green Card.

Visa applicants who are not already in the United States upon approval of their I-526 form have to file the DS-230 application to obtain the conditional permanent residency status during the visa process. It can be filed by EB-5 applicants or by an Immigration Attorney at a U.S. consulate or embassy abroad. It requires an interview at the U.S. consulate or embassy.

The conditional permanent residency status is given to applicant after their DS-230 is approved. It enables the applicants and their dependents to permanently move to the United States. An immigration attorney can also help file your DS-230 application.

Visa applicants provide biographical information on the DS-230 application. It is a 4 page long form. The first part of the application is completed and submitted by the applicant themselves, whereas the second part of the application is completed in the presence of a consular officer at the U.S. consulate or embassy.

For the applicant’s DS-230 form being accepted by the USCIS it is important to satisfy the requirements below:

  • Part I of the DS-230 application focuses on the standard biographical information. Applicants must also provide a list of all their previous residences, job history from the past 10 years, and if any military service information.
  • Part II of the DS-230 application is completed during the interview at the U.S. embassy or consulate. This section of the application is completed with the assistance of a consular worker. The applicant may be required to bring documentation such as marriage certificates, birth certificates and passports to their interview. The application is completed and signed only after the interview has been conducted. 
  • Separate DS-230 applications must be filed for each family member who will accompany the investor/primary applicant to the United States to become a permanent resident.

I-485 application is needed prior to this application.
